These Terms & Conditions (the “Terms”) govern your access to and use of opxons.com (the “Site”) and any related products, services, applications, content, and features (collectively, the “Services”) provided by opXOns (“we”, “us”, “our”). By accessing or using the Services, you agree to be bound by these Terms.

1) Eligibility

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services.
  • You represent that you are legally capable of entering into a binding contract and that your use complies with applicable laws.

2) Accounts, Security, and Responsibilities

  • You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
  • You must provide accurate, current, and complete information and keep it updated.
  • You must promptly notify us at support@opxons.com of any suspected unauthorized access or security incident.

3) KYC/AML, Verification, and Compliance

  • We may require identity verification, KYC/AML checks, and additional information at any time, including before enabling certain features.
  • You authorize us to make inquiries and/or verify information (directly or through third parties) to confirm your identity and assess risk.
  • We may refuse, suspend, restrict, or terminate Services where required to comply with law or risk controls.

4) Financial and Digital-Asset Risk Disclosure

  • Digital assets and related services may be volatile and involve risk of loss, including total loss.
  • Nothing on the Site constitutes investment, legal, tax, or financial advice. You are solely responsible for your decisions.
  • Past performance is not indicative of future results. You should seek independent professional advice where appropriate.

5) User Conduct and Prohibited Use

  • No illegal activity, fraud, money laundering, sanctions violations, or terrorist financing.
  • No attempts to gain unauthorized access, disrupt systems, scrape, reverse engineer, or bypass security controls.
  • No distribution of malware, phishing, spam, or harmful content.
  • No infringement of intellectual property or misuse of others’ personal data.

6) Fees, Pricing, and Taxes

  • Fees (if any) may apply to certain Services and will be disclosed within the applicable product flow or documentation.
  • You are responsible for any taxes, duties, or governmental charges arising from your use of the Services.

7) Transactions and Service Availability

  • Transactions may be irreversible and subject to network conditions, confirmations, third-party providers, and technical limitations.
  • We do not guarantee uninterrupted availability of the Services and may suspend or modify features for maintenance, upgrades, security, or legal reasons.

8) Third-Party Services and Links

  • The Services may integrate or link to third-party services (e.g., networks, payment processors, analytics providers).
  • We are not responsible for third-party services, content, or policies. Your use is at your own risk and subject to third-party terms.

9) Intellectual Property

  • The Site and Services, including software, design, text, graphics, logos, and trademarks, are owned by or licensed to opXOns and protected by applicable laws.
  • You may not copy, modify, distribute, sell, lease, or create derivative works except as expressly permitted by these Terms.

10) Privacy and Cookies

  • We process personal data as described in our privacy policy (if published separately). If not, we process data for operating the Services, compliance, security, and support.
  • We may use cookies or similar technologies for functionality, security, and analytics.

11) Suspension, Restriction, and Termination

  • We may suspend, restrict, or terminate your access to the Services at any time where we reasonably believe: (a) there is a security risk, (b) you violated these Terms, (c) required by law, or (d) for risk management.
  • Upon termination, provisions that by their nature should survive will survive (including IP, disclaimers, limitations of liability, and dispute terms).

12) Disclaimers

  • The Services are provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.
  • We do not warrant that the Services will be error-free, secure, or uninterrupted, or that defects will be corrected.

13) Limitation of Liability

  • To the fullest extent permitted by law, opXOns will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses.
  • To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the greater of: (a) fees paid by you to us in the 3 months prior to the event giving rise to the claim, or (b) USD $100.

14) Indemnity

You agree to defend, indemnify, and hold harmless opXOns from and against claims, liabilities, damages, losses, and expenses arising out of your use of the Services or violation of these Terms.

15) Governing Law and Disputes

These Terms are governed by International Law. Any dispute shall be subject to the jurisdiction of Local courts (unless applicable law requires otherwise).

16) Changes to These Terms

We may update these Terms from time to time. The “Updated” date above indicates the latest revision. Continued use of the Services after changes become effective constitutes acceptance.
